Eugene Volokh explains why the comparison between Moore and Newsom is not apt. His explanation is basically the same as mine, but a little more eloquent and with a little more detail. I also suspect his explanation will be (rightfully) slightly more influential. I disagree with Volokh about the merits of the case, but we agree that unless Newsom defies a court order it is perfectly legitimate for him to follow what is a reasonable interpretation of California law.
